CREDIT REPORTING BASICS
Credit bureaus are clearinghouses that collect and store factual information on consumers' payment histories. A consumer credit report is a factual record of an individual's credit payment history. It is provided for a purpose permitted by law, primarily to credit grantors. Its main purpose is to help a lender quickly and objectively decide whether to grant you credit.

Most of the information in your consumer credit report comes directly from the companies you do business with. Credit reports generally contain four types of information:

  1. Personal identifying information such as name, address, social security number, year of birth, current and previous employers, and, if applicable, spouse's name.
  2. Credit information such as the credit accounts you have with banks, retailers, card issuers, and other lenders.
  3. Public record information such as from court records related to bankruptcies, tax liens, judgements, and in some states overdue child support payments. Bankruptcy information can remain on your credit report for up to 10 years, and other public record information for up to 7 years.
  4. Inquiries, which are the names of everyone who obtained a copy of your credit report for any reason. The inquiries section contains a list of everyone who accessed your report for up to two years.
YOUR CREDIT REPORT DOES NOT CONTAIN any information about your race, religious preference, medical history, personal lifestyle, personal background, political preference, or criminal record. Nor is there information about your checking or savings accounts. The bureaus make every effort to maintain accurate information, but errors can occur. It is a good idea to check your credit report once a year.

TO OBTAIN A COPY OF YOUR CREDIT REPORT
Contact the following credit bureaus. With the exception of certain states, all charge $8-$8.50 for a single, $16-$17 for a joint, report.

If you are denied credit because of information contained in a report, the bureau supplying the report will provide a free copy if you request it within 30-60 days. Not all credit grantors report to all three of the bureaus, so to get a complete picture of your credit history, you may need a report from all three.

CREDIT REPAIR SCAMS

Because of the important role credit reporting plays in today's world--it can affect our ability to get loans, employment, insurance, housing--there are individuals and companies that offer to clean up bad credit histories for a fee . . . usually a very LARGE fee. It is important for consumers to know that these companies, often called credit repair clinics, can do NOTHING MORE (legally) for you than you can do for yourself for free. Even on the Internet there are promotions to clean up tax liens, bankruptcies, judgments, etc. legally. It can't be done. What usually happens is they flood the bureaus with spurious disputes, which removes the information temporarily while it is under investigation. But if the disputed information is verified as legitimate, then it comes right back on again. The only way to clean up bad credit is to pay those debts and begin to establish a consistent, pays-as-agreed payment pattern.

It is now illegal for credit repair services to request payment until six months after they have delivered the service. Avoid companies that want you to pay BEFORE they provide services.

Warning signs of scam offers:

  1. The company wants you to pay BEFORE delivery of service.
  2. They do not tell you your legal rights and that you can do it for yourself for free.
  3. They recommend that you do not contact a credit bureau directly.
  4. They advise you to dispute all information in your credit report or take any action that seems illegal such as creating a new credit identity. If you follow any illegal advice, or commit fraud, you also may be subject to prosecution.

Negative Information Reporting Guidelines:
  1. Bankruptcy can be reported for up to ten years.
  2. Information reported because of an application for a job with $20,000 or more per year salary has no time limit.
  3. Information reported because of an application of more than $50,000 worth of credit line or life insurance has no time limit.
  4. Default information concerning a US government insured or guaranteed loan can be reported for seven years after certain guarantor actions.
  5. Information concerning a lawsuit or judgement against you can be reported for seven years or until the statute of limitations runs out, whichever is longer.

REESTABLISHING CREDIT
For individuals who have damaged credit histories, rebuilding and reestablishing credit will take some time, but it can be done.

Many banks and credit unions will now offer a secured credit card whereby the consumer deposits a specified amount into a savings account that becomes security for the credit card. This account may not be used to pay monthly payments. You must do that on your own; that's how the positive credit history is built. After a period of responsible use, the bank will usually convert the card to a standard credit card account.
